Sup gang,

As promised the reimbursements are being put up on the forum.. sorry it wasn't sooner, but I had a final this morning!

What we need from all of you are your permanant (summer) addresses to mail these checks out! So PM me. Please put it in this format (it will make it easier for copying/pasting into excel.

Thanks you guys! I'm happy that we get to give back a little of your expenses for your A-race this year. Can't stress how proud I am of every single one of you guys for the work that you all put in. Both in fundraising, and in training/racing.

Let me know if there are any errors ASAP! I'm going to tentatively say that if your adresses aren't in by the end of this month than it will be too late.

Hey Makko, I just thought

Hey Makko,

I just thought of this, but I'd really like to do something with my refund ...other than buy more tri gear. I know there must be some non-profit organizations that help disabled kids get into triathlons/sports/etc. (as one example). Maybe the Kids Try-athlon we volunteered at is one such organization.

I'd like to donate my refund to that type of organization, but have it be from Tricats. IDK, would be nice to give back to the Tucson community that has supported us this year.

I have tried to contact Makko, both via e-mail and PM. but I guess he's very busy this week. Maybe someone of the other officers could answer this question.

I don't think we even use checks in Sweden, so I figured a convenient solution would be if I could just get half of "my" fundraising money (would be nice to have some pocket money when I'm traveling to L.A. on Friday) in cash and leave the rest on the Tricats account for future needs or do what Christina suggests with it.

What say You, Andrew P / Kyle W / Angela? Is this possible?

Sean, yours has been sent to the Phoenix address you posted above. I've sent out a bunch of these checks, spending most of the Foundation funds we've received. The Foundation or the Rec Center (it's unclear which) has somehow had amnesia about $2000 or so of our money, and I am trying to prod them to get their act together. This is somewhat frustrating. I hope that by the end of July I'll be able to send out the rest of the checks.

No worries, Shawn -- my reply was not very clear. What I meant was, I sent out a batch of 16 of these checks, mostly on May 29. That batch happened to include your reimbursement. The remaining checks are unfortunately being held up by the abovementioned problem.

Sorry for the silence -- my

Sorry for the silence -- my summer class has been a killer. It's almost over though.

Here is the problem. The Rec Center tells me that apparently U of A Foundation has lost about $2000 worth of our donation checks. One positive thing is that we have good records of what checks arrived, and so they do know which checks they lost. Their proposal is to contact those donors and ask each of them to write a replacement check, and to foot the bill for a stop-payment charge on each lost check. But there is no way they are going to get it sorted out before the start of classes though.

This puts us in a bind. As the outgoing treasurer, I'm going to hand the checkbook over to Jessica, and I will have to hand the problem over to Cameron and the new officers, for them to decide how to handle it. Pro rate the remaining reimbursements? Wait till the full amount comes in? Something else? There are pluses and minuses to weigh and it's the kind of leadership decision that needs the upcoming officers' input.

From your language I assume that we gave the checks to the foundation, and they then lost the checks.

In law when someone passes property to another person to hold on their behalf, the holder then becomes responsible for that property (unless the contractual arrangement provides otherwise) and any damage/loss that occurs while it is in their possession.

To avoid unauthorized practice of law I will not apply this general rule to the facts in our situation (also since I am not aware of all the facts, any verbal/written contracts involved, or applicable University/Foundation policies).

I agree with you Lee. It seems to me (without knowing all the details) that the proper response in this situation is for the foundation to suck it up and give us our 2k back. In addition a letter should be sent to all the people who wrote checks explaining why their check has not been cashed (i'm sure at this late date it is driving people who balance their checkbooks CRAZY), but not asking them for another check because that is not professional.

Agreed.  This does not sound like it should be our problem, the foundation recognizes the checks were given to them.  It is disconcerting to me that their response is you go fix it, and not it was our mistake and we will make up for it.  I hope we put some pressure on them to rectify the situation.  (A letter with well placed legalese does wonders at scaring organizations into action)

While I am among the first to jump into legalese, "action" can mean a lot of things, not all of them positive (especially if an organization feels threatened). We do, I presume, need to maintain an ongoing relationship with the foundation, so should be tactful in how we address the situation. Fortunately for us this is what we pay(sort-of) our elected leaders to handle. ;-)

I definitely see your position, Lee, Sarah, and Kyle (and probably a lot of you). Let me add a few things, because my previous post was pretty short---a few words in the Foundation's defense, and then a suggestion:

  • First, the Foundation is, at the behest of the Rec Center, going to try to fix things up. They are going to send out letters to our donors, with (I was told) an apologetic tone, asking for a new check. Yes, I am sure those donors are someone irked that the checks haven't been cashed. Some probably will send a replacement check and some won't.
  • We don't have much power here. The fact is, every check that was lost said, "Pay to the order of the U. of Az. Foundation"; so in a sense the Foundation could say, "We lost our own money, not yours; it is our affair." (I realize that only tells part of the story.)
  • It surely would be nice if the foundation would just give us that $2k to us. That scenario is, I think, possible, and I would like to press for it, but it will take a lot of polite, persistent persuasion to get them to do that. They will have a lot of reasons why they can't: because their money is all tracked, they don't have a budget for it, donations are only given for certain purposes, etc. We don't have to concede those reasons, and I think it's going to fall to the officers to push for this. It *might* happen---that would be great---but it will take more pushing than I have in me right now.
  • As we discuss this on the website, let's try to avoid being antagonistic, because all kinds of people read what we post here. Basically we need to persuade the foundation that it is in *their* interest to make these funds available to us. After all, the Foundation exists to help the university. They already *do* help us: they make our donations tax deductible. This request would be in line with their goals, too.
  • We might have to compromise on how much we get.

As a former officer, I feel entitled to say, go ahead and complain about this as loudly and antagonistically as you like to any of the officers, in private. They will be glad to hear your opinion. :-)
